Faculty of Law Hosts Seminar on Evidence in Civil Justice
A scientific seminar titled “Evidence in Civil Proceedings” was held at the Faculty of Law of Baku State University (BSU) as part of events dedicated to Science Day on March 27.
The presentation was delivered by Seymur Huseynov, a doctoral student of the Department of Civil Procedure and Commercial Law. The report examined modern aspects of the evidence system and the role of judges, based on a comparative analysis of the legislation of Azerbaijan, Germany, and Slovenia.
Participants noted that, under the Civil Procedure Code of Azerbaijan, the burden of proof lies with the parties, who must substantiate the claims they rely on. If the available evidence is insufficient, the court may request additional materials from the parties.
The seminar also discussed the digitalization of legal procedures, including the submission of written evidence through the “Electronic Court” system, and emphasized the importance of maintaining a balance between the adversarial principle and the active role of judges in civil proceedings.
